General terms and conditions of business

1. Scope of Application & Contractual Partner

1.1 These General Terms and Conditions (hereinafter “GTC”) apply to all contracts regarding the rental provision of flats and apartments for accommodation purposes concluded between GIH Solar UG (limited liability) (hereinafter “GIH Apartments”) and third parties (the “Guest”), as well as to all additional services and deliveries provided by the aforementioned company.

1.2 The Guest’s contractual partner in Germany is GIH Solar UG (limited liability).

1.3 The customer’s own general terms and conditions shall only apply if expressly agreed in writing in advance.

2. Reservations / Booking

2.1 By making a reservation/booking, the Guest submits an offer to conclude an accommodation contract. Subject to availability of the booked apartment, the Guest will receive a reservation/booking confirmation from GIH Apartments. Upon confirmation, an accommodation contract is concluded between GIH Apartments and the Guest.

2.2 Offers made by GIH Apartments regarding available apartments are non-binding and subject to change. GIH Apartments reserves the right to refuse the conclusion of an accommodation contract at its own discretion.

2.3 If the Guest books only an apartment category, the Guest has no entitlement to a specific unit/apartment. Industry-standard restrictions such as minimum stays, booking guarantees, or deposits for certain travel dates remain reserved.

3. Cancellation Periods / Withdrawal / No-Show

3.1 A reservation is only guaranteed once payment has been received by GIH Apartments. The Guest may cancel free of charge in accordance with the stated cancellation terms and deadlines, providing the reservation details (booking name and period). If no right of withdrawal has been agreed or the free cancellation period has expired, there is no statutory right of withdrawal or termination. If GIH Apartments does not agree to contract termination, GIH Apartments remains entitled to the agreed remuneration despite non-utilization of the service (no-show) or late cancellation. GIH Apartments shall credit any income from re-letting the apartment as well as saved expenses. If the apartment is not re-let, saved expenses may be deducted as a lump sum. In such case, the Guest is obliged to pay 90% of the contractually agreed accommodation price. The Guest may prove that no damage or a lower damage occurred. In the event of a no-show for multi-night guaranteed reservations, all subsequent nights will be cancelled from the first night onwards, and the Guest has no claim to remaining nights.

3.2 For reservations made on the day of arrival, payment according to Section 5 must be made immediately, generally within one hour.

4. Accommodation Prices & Other Prices

4.1 The prices stated by GIH Apartments at the time of contract conclusion apply. Prices are gross and include all statutory taxes, fees, and charges. Local charges payable by the Guest (e.g., tourist tax) are not included.

5. Payment Terms & Invoice

5.1 The accommodation price must always be paid in advance by the Guest.

5.2 Offsetting by the Guest is excluded unless it concerns an undisputed or legally established claim.

5.3 Accepted payment methods include MasterCard, Visa, American Express, Sofortüberweisung/Klarna, PayPal, or regular bank transfer. Cash payments are not accepted.

5.4 GIH Apartments reserves the right to charge stored payment methods for additional services used or violations of these GTC. The Guest expressly authorizes GIH Apartments to do so.

5.5 By making a reservation, the Guest agrees to receive the invoice via download or email.

6. Use of Reserved Apartments

6.1 A reserved apartment is available to the Guest during the booked period.

6.2 Keys, parking permits, and/or key cards provided must be left in the apartment at check-out at the designated location. Loss or non-return results in a fee of €40.00. Further damages exceeding €40.00 may also be charged, including replacement of locking systems if required. The Guest may prove that lesser or no damage occurred.

6.3 Late check-out may be arranged upon request and availability. If approved, GIH Apartments may charge €10.00 per started hour. Without approval, €30.00 per started hour applies. Departures more than 3 hours late may incur the full overnight rate. The Guest may prove that lesser or no damage occurred.

6.4 The Guest has no contractual entitlement to late check-out.

6.5 Early check-in may be arranged upon request and availability. If approved, GIH Apartments may charge €10.00 per started hour. The Guest has no contractual entitlement to early check-in.

7. Transfer, Subletting, Use

7.1 Subletting or resale of booked apartments is prohibited, especially resale at higher prices. Assignment or sale of claims against GIH Apartments is also not permitted. In such cases, GIH Apartments may cancel the reservation.

7.2 Use of apartments for purposes other than accommodation is strictly prohibited, including commercial or illegal use. Photo or video recordings are also prohibited without explicit consent. GIH Apartments may cancel without refund and clear the premises.

8. Liability of GIH Apartments

8.1 GIH Apartments is liable without limitation for damages resulting from injury to life, body, or health. Liability also applies for intentional or grossly negligent breaches of duty. In cases of slight negligence, liability is limited to foreseeable contract-typical damage, provided a cardinal obligation is breached. Further claims for damages are excluded unless otherwise regulated herein.

8.2 In case of disruptions or defects, GIH Apartments will remedy them upon immediate notice. The Guest must contribute reasonably to minimize damage.

8.3 GIH Apartments is liable for items brought in according to statutory provisions. Claims expire if not reported immediately after becoming aware of loss/damage. Items exceeding €800 in value or other items exceeding €3,500 require a separate written agreement.

8.4 No safekeeping contract arises for parking spaces. Liability applies only in cases of intent or gross negligence.

8.5 Claims generally expire after one year, except for injury or gross negligence/intent.

8.6 GIH Apartments assumes no liability for lost property. Items are returned only upon request for a fee plus €15.00 handling charge. Storage is limited to six months.

9. Security Deposit

9.1 GIH Apartments may require security deposits as follows:

9.3 For stays of three to six months: one monthly accommodation price

9.4 For stays under three months, the deposit may be pre-authorized via payment method. Without deposit, no entitlement exists. Failure to pay may result in termination without notice.

9.5 GIH Apartments must settle the deposit within one month after contract end.

10. Customer Data

10.1 GIH Apartments collects email addresses and phone numbers for communication. A valid ID document may be requested digitally at check-in.

10.2–10.4 If identity cannot be verified, GIH Apartments may cancel the booking. Fraud prevention software may be used, and suspicious bookings may be cancelled.

11. Termination of the Accommodation Contract

11.1 GIH Apartments may terminate the contract for good cause, especially in cases of force majeure, risk to operations, misleading information, illegal purposes, or prohibited resale.

11.2 No compensation claims arise for justified termination.

11.3 Future bookings may also be cancelled or refused.

12. Vouchers

12.1 Vouchers may only be redeemed for GIH Apartments services. Remaining balances remain valid. 

12.2 Vouchers are non-refundable, non-transferable, and not redeemable for cash.

12.3 The purchaser is responsible for correct recipient data.

13. Smoking Ban & Safety Devices

13.1 All apartments are non-smoking. Smoking is prohibited, including e-cigarettes and similar devices.

13.2 Smoking on balconies/terraces is only allowed if marked and the door is closed.

13.3 Violations may incur damages of at least €250.00.

13.4 Tampering with emergency exits, fire extinguishers, alarms, or sensors is prohibited and may result in a €150 fine.

13.5 Bookings may be terminated immediately without refund.

13.6 Guests are fully liable for false fire alarm activations.

14. Prohibition of Parties and Gatherings

14.1 Noise must be avoided. Quiet hours apply from 10 p.m. to 6 a.m.

14.2 Parties and gatherings are strictly prohibited.

14.3 Violations may incur damages of €500.00.

14.4 Noise sensors and video surveillance may be installed.

14.5 Immediate termination without refund is possible. Security service costs may be charged.

15. Damage or Unauthorized Removal of Inventory

15.1 Damage beyond normal use or removal of inventory results in compensation, including lost revenue, legal costs, plus a €50 handling fee.

16. Pets

16.1 Pets are not permitted, except certified service dogs.

16.2 Unauthorized pets incur a cleaning fee of €150.00 and may result in immediate termination.

17. Maintenance

17.1 Guests must treat apartments carefully. Excessive soiling may incur cleaning fees from €50.00.

17.2 Guests must report defects immediately.

17.3 Guests are liable for damages caused by them or visitors.

17.4 For stays longer than 7 nights, weekly interim cleaning may be conducted.

18. Internet Use

18.1 Internet access is provided where technically possible.

18.2 Misuse is prohibited (illegal downloads, streaming, criminal content). Guests indemnify GIH Apartments against third-party claims.

18.3 Sharing access data is prohibited.

18.4 Internet access may be blocked in case of violations.

20. Final Provisions

20.1 Amendments require written form. Unilateral changes by the Guest are invalid.

20.2 Place of performance and payment is the company’s registered office.

20.3 Exclusive jurisdiction is the company’s registered office for commercial transactions.

20.4 German law applies. UN sales law is excluded.

20.5 If any provision is invalid, the remainder remains effective. A valid provision closest to the intended purpose shall replace it.

20.6 GIH Apartments is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
